Xtrument Terms of Use
These Terms are an agreement between you and Hliuma LLC. They cover the Xtrument app for iPhone and iPad and the Xtrument Pro subscription. We have tried to keep them short and readable. If anything is unclear, write to us.
1. About these Terms
Xtrument is developed and published by Hliuma LLC, a Delaware (USA) limited liability company (“we”, “us”). By downloading or using Xtrument you accept these Terms. If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you.
Your license to the app itself is governed by Apple’s Licensed Application End User License Agreement. These Terms add the rules that are specific to Xtrument. If the two disagree about the license, Apple’s agreement prevails.
This agreement is between you and us only, not Apple. We, not Apple, are responsible for Xtrument and its content. Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you. Xtrument has no user accounts and no sign‑in.
2. Using Xtrument
We give you a personal, limited, non‑transferable license to use Xtrument on any iPhone or iPad that you own or control, as allowed by Apple’s Usage Rules. In return, you agree not to:
- copy, sell, rent, lend or share the app;
- reverse engineer, decompile or disassemble it, except where the law expressly allows it;
- extract, decrypt, copy or redistribute Xtrument’s sounds or wavetables;
- bypass or interfere with license checks, preview limits or the one‑device rule.
3. Free and Pro
Xtrument is free to download and free to use with the tuner, hall reverb and delay. Everything else is part of Xtrument Pro: all Pro sounds, effects and tools.
4. Xtrument Pro subscription
Xtrument Pro is a monthly auto‑renewable subscription sold through Apple’s App Store. Payment is charged to your Apple ID account when you confirm the purchase. The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. You can manage or cancel it at any time in your App Store account settings. Deleting the app does not cancel the subscription.
There is no free trial and no introductory offer. Xtrument Pro is not shared through Family Sharing. Refunds are handled by Apple under Apple’s own rules, because Apple processes the payment.
One device at a time. Pro runs on one iPhone or iPad at a time. You can move it to another device from the app (Setup → Xtrument Pro). Both devices need an internet connection, and the old device is released first, so Pro never runs on two devices at once. If your old device is lost or broken, Pro moves automatically three days after that device last contacted our server, or sooner if it comes online and is released. After repeated moves in a short time, a waiting period may apply.
Offline use. Pro needs an internet connection at least once every three days. Otherwise the app falls back to the Free features until it connects again. Nothing is lost; Pro returns as soon as the app can reach our server.
Pro preview. You can try every Pro feature before subscribing. The preview needs an internet connection. While a Pro option is on, the master volume fades out and back in every 30 to 60 seconds. Each device currently gets 30 minutes of preview per 24 hours; after that, new preview time becomes available 24 hours later.
App version. To keep the subscription secure, Pro may require a minimum version of the app. If that happens, you will need to update the app from the App Store.
5. Your content and your music
You may load your own sound bank files (.sf2) into Xtrument. You are responsible for having the rights to the files you load. Your presets and settings stay on your device, and your audio never leaves your device unless you export a file yourself.
The music you make with Xtrument is yours. You may use audio you create with the app in your own recordings and performances, including commercially, with no credit required.
6. Integrity and fair use
Our license server may refuse Pro on jailbroken or modified devices, or if the app has been tampered with. We may also suspend or end your Pro access if you break these Terms. If you believe a refusal is a mistake, write to us and we will look into it.
7. Intellectual property
Xtrument, its software and its factory sounds and wavetables belong to Hliuma LLC. The factory sounds are encrypted and proprietary. Some bundled sound banks and software components are open source; their licenses are listed on the Licenses screen inside the app and apply to those parts. If anyone claims that Xtrument infringes their rights, we, not Apple, are responsible for handling that claim.
8. Privacy
Our Privacy Policy explains the little we process and the much we never touch. Xtrument has no analytics and no tracking.
9. Disclaimers
To the extent the law allows, Xtrument is provided “as is”. We do not promise that it will be free of errors, that it will run on every device, or that pitch detection will always be accurate. We, not Apple, provide maintenance and support for Xtrument; Apple has no obligation to provide either. If Xtrument fails to meet a warranty that applies by law, you may notify Apple, and Apple will refund the purchase price of the app, if any. Apple has no other warranty obligation.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for lost data or recordings. Our total liability for any claim related to Xtrument is limited to the amount you paid for Xtrument Pro in the 12 months before the claim. We, not Apple, handle any claims about Xtrument, including product liability, regulatory, consumer protection and privacy claims. Nothing in these Terms limits rights that the law does not allow us to limit.
11. Changes
We keep improving Xtrument, so we may change its features, including what Free and Pro include. We may also update these Terms. The date at the top shows the current version. If you keep using Xtrument after a change, the new Terms apply to you.
12. Ending the agreement
You can stop using Xtrument at any time. To stop paying, cancel the subscription in your App Store account settings. Your license ends if you break these Terms. We may stop offering Xtrument or Xtrument Pro. Sections 5, 7, 9, 10 and 13 continue to apply after the agreement ends.
13. Governing law and compliance
These Terms are governed by the laws of the State of Delaware, USA, without removing any protection that the consumer law of your country of residence gives you and that cannot be waived by agreement.
You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties. You must also comply with any third‑party terms that apply when you use Xtrument, such as your network provider’s terms.
